A Study of Doctrine of Legal Capacity of Woman in Islamic Family Law
The present research endeavors to explore the legal capacity doctrine in Islamic law
particularly in the context of woman’s position as the subject of Islamic Family Law. The
aim of the research is to determine the true nature of legal capacity of woman defined in
Islamic family law. It is provided that Allah almighty has made woman a subject of law
equally as man on the basis of humanity based on the doctrine of dhimmah. However,
owing to presentation by Muslim jurists of female subject especially in Islamic family law
resulted in deficit capacity of woman. After discussing the status of woman and family law
in Qur’an and ḥadith the research explains the doctrine of Legal Capacity especially effects
of impediments on woman’s legal capacity. The research after answering the basic question
concentrates on legal capacity of woman in Islamic family law mainly in marriage contract
and dissolution of marriage. While exploring the nature and significance of woman’s legal
capacity in marriage in Islamic law the research focuses inter alia on the consent of woman
in marriage contract along with the true role of guardian in that contract, woman’s capacity
to get dower and maintenance, issues relating to justice in polygamy and various restriction
in marital relation upon woman. While exploring the legal capacity of woman regarding
dissolution of marriage the research mainly considers the divorce by husband, al-khul by
wife, delegated divorce and the issues relating to waiting period (iddah). After exploring all
the relevant issues that explains the true nature of the legal capacity of woman in Islamic
family law the research finally concludes that ultimate goal of marital relations as provided
by the teachings of Quran and Sunnah can be achieved by considering the capacity of
woman absolute in marital relations as Islam has granted to the Muslim woman.

The universe is the home of Natural Disasters and
catastrophes from day one. The expansion of human settlements
and sudden increase in population, worsen the situation. As
human are long fighting for survivals, it was believed in ancient
time that to fight the hard weather is the only purpose of life.
Different Civilization, ancient Rom and Greeks used to be in
love with several myths and legends across the world regarding
the calamites and. " Stephen Hawking" told that once during a
lecture on Astronomy a lady told him that "earth is flat plate
supported on the back of a giant tortoise " While today's man
despite its progress towards Technology, civilization and
education is seen to be unaware of natural disasters and their
consequence in his ignorance. First chapter of thesis throwes
light on philosophy of natural disaster, beginning of universe
and its end, according to Islam and science. Scientist believed,
whatever has happened or will, it will be happened under the
strict laws of Nature, while Islam says yes, laws which laid
down by Allah. Big Bang theory is well described in Quran, and
then it comes to "Expanding Universe theory of (Edam Hubble)
which is very much according to Quran, then it comes to (Big
Crunch theory) which Quran says is dooms day, and finally the
(osculating universe theory), which Quran says is infect, will be
the life hereafter. All of these are great Resemblance of Quran
and Modern Science.
Second chapter elaborates the different dimension of
Catastrophe's, like Methodology of their measurement, their
short- and long-term impacts, thier gendered based impacts and
finally the human negligence on their part. Third chapter is a
deep study of positive and negative impacts of Disasters. Like
their Geographical impacts, and Social vulnerability and
economic threats of catastrophes. Fourth and final chapter
throws light on Islamic instruction and guidance regarding
natural disaster, that how-to asses disaster deal with it during
and after a catastrophe. Quran narrated their causes and cure as
well. Islam relates blessings and calamites with deeds. Islam has
a Mechanism for both worlds to be a paradise.

The ideology of Pakistan is to be an Islamic Nation but Pakistani apparently seem fail to achieve this target,
why? In this perception Scholar fond a deficiency in EDUCATIONAL SYSTEM, which is not accord with
Ideology of Pakistan whereas educational Objectives and goals have rationality to Ideology of Pakistan .
Education is the biggest project of the man which is started by the teaching of Allah SWT directly to
Adam A.S and it will continue up to destruction of this world. From up to bottom Islamic Studies has been
keeping the capability of an integrated education; to make a complete growth of an individual like spiritually,
physically, politically and scientifically etcetera through its curriculum. Unfortunately Pakistani couldn’t
neither be aware by the capacity nor engage about. This awareness will be come in Nation through formal
education which is taught by a specific designed Curriculum. Curriculum is another name of a mechanism to
achieve educational goals. Scholar analyzed how to make easier to achieve the goal and whether these goals
are being achieved by the introduced “National Curriculum of Islamic Studies” or not? So the topic:

is to search the harmony of Educational objectives with National curriculum of Islamic studies, it was sought
almost all big Curriculum of Islamic Studies in Pakistan and compared those with objectives of education. In
Pakistan Islamic Study is taught in different type of schools and Universities as a compulsory subject which is
covered a little part of education instead of a complete picture of Islam whereas “Curriculum” itself intent to
show a complete picture of its subject.
In short until unless education is not be gathered from its dichotri; religious education and mundane
education, it might unable to achieve its objectives properly .It is possible to finish this division/ dichotri
keeping in view the Golden history of Islam which had integrated education. Scholar suggested some
suggestions to achieve the objectives properly otherwise education may be remained objectiveless in Pakistan.

The impact of globalization is a recognized fact. It affects every nook and
corner of the world and Pakistan is no exception. Scholars have provided
different definitions of globalization to convey its meaning
comprehensively. According to some scholars, “globalization” refers to the
global economic world while others define it as a global political world. Its
impact could be positive as well as negative.
It is argued that the globalization mixes almost all values of life in
terms of economic, social, political, civil and cultural aspects. Muslim
countries are adversely affected by its impacts, as many of its aspects
oppose certain teachings of the Qur’ān and sunnah, which are fundamental
to Muslim culture and society. As a result, younger Muslim generations are
getting unfamiliar with their traditions and values.
Pakistan also suffers from the negative effects of the globalization.
Globalized culture influences politics, education, ethics, behavior, and
religious attitudes. The educational system, social values, and ethics have
degenerated but the negative effects are rampant on the family institution in
Pakistan from various angles such as the lack of respect for parents,
teachers, and elders among children. This situation is alarming for many
traditionalist parents particularly and for the whole society generally.
Islamic teachings help us to understand family as a unit of society in a
broader spectrum. However, the negative effects of the globalization can be
observed by exponential annual increase in divorce rate during the recent
years. For instance, in 2016, twenty percent more divorce (talaq and khula)
cases were reported. This number is increasing by each passing year. This
imposes a threat to the fundamentals of our society. This thesis
“Effects of Globalization on the Muslim Family System of Pakistan in the
Twenty First Century”
is a humble effort to understand the theory of globalization and
suggest some ways to stop its adverse effects, which are painful to Muslim
and Pakistani culture and society especially. Some principles are also
described so that a Muslim or Muslim society can utilize the globalization.
The research is based on the critical analysis of comparative values
involving the institution of family in various societies. It also descriptively
explains the issues related to marriage breakups. A chronological analysis
of family cases decided in the courts of Pakistan is also a medium to find
the divorce ratio in the recent past. The study concludes with few solutions
to family disorder from the fundamental teachings of Islam

THE CRITICAL ANALYSIS OF THE HISTRICAL EVENTS
REGARDING SEERAT -E-TAYYEBA (In The Light of Quran & Hadith)
This research work is divided into four chapters. The research is very dear
and matchless due to its relation with the authentic events of Seerat -e-Tayyeba
in the both historical and seerat'sbooks. In this research the Events regarding
Seerat are also analysed on the basis of Narration's Rules) )اصولِ روایتandLogical
Rules
) )اصو ِل درایتmade by Muhaditheen for judging Narrations of the Narrators
and the texts of Hadiths. Actually there are many problems in seerat regarding
events especially, the miracles happened just before the birth of the prophet
Muhammad (P.B.U.H), immediate after his birth, and the period before he
reached his age. Most of the Seerat collectors concentrated just only on the
collection of Seerah therefore they couldneitherhave judged the Narrators nor the
text of the Narration. Most of the Seerat Narrators are liars and their texts of
events are illogical and nonsence. Therefore, I have tried to critically discover the
weak points of false Narrators and their illogical texts in this research. And I have
mentioned fifty events taken from both historical and Seerat’s books Eighteen of
the events are mentioned in the second chapter where as the rest of thirty two
events are mentionsed in the third chapter.

The purpose of this research work was to explore the concept of Allah's wrath with
respect to Quran and Sunnah. Descriptive and thematic research approach was
employed for collection, analysis, and demonstration of data. In addition to that the
author also took views of experts of Islamic studies about motives, forms
misconceptions about Allah’s wrath. The systematic review of literature disclosed that
previous nations were misunderstood about the concept of Allah’s wrath and were
destroyed through various forms of torment. Unfortunately, majority of Muslim
Ummah was also found involved in same misconceptions which had seriously
affected the religious, social, moral and economic life of Muslims and gave birth to
number of problems into the society. The research was triggered by observing the
results of these misapprehensions in the form of delict, disobedience, insubordination,
non-compliance and social crimes. The author therefore intended to address the
motives and causes of Allah’s wrath on ideological and practical grounds, its forms in
this world and hereafter, lessons and admonitions for Muslim Ummah, common
misconceptions and effects of these misapprehensions on religious, social, moral and
economic life. After drawing the conclusions, the research recommended that
religious scholars, preachers, orators and authors of Islamic literature should explain
the correct concept of Allah’s wrath as well as expose the associated misconceptions
in order to prevent Allah’s anger.

Islam is complete code of life for entire humankind. According to the Holy
the Quran all humanbeings have been created from a single person (Adam).
By birth all are equal and as human beings all are equally respected and have
all fundamental rights irrespective their religion. If a group is numerically
inferior to the rest of the population of state in a non-dominant position, will
not be considered minority according to Quran. Quran classify people into two
different categories: believers and non-believers on the base of their belief
instead of numerical value. Minorities enjoy all fundamental rights and
freedoms in Islamic territory.This research demonstrates in the light of Quran
and Sunnah that Islam does not discriminate between Muslims and nonMuslims in the matter of rights.
In the present age the people other than the muslims especially the western
consider Islam and the Muslims threat for the piece of the world. The world
has practically become a global village due to advancement in modern
technology. This is need of the time that people belong to different religions
and ethnic backgrounds have to live together so the westerns think Islam is
against pluralistic society as it does not accept and bear others. This research
might prove that Islam is in favor of pluralistic society and islam provide all
fundamental rights to all human beings without discrimination of religion and
belief, so this thesis has been divided into six chapters.
The first chapter deals with the literal and technical meaning of minority and
its kinds, the concept of minority in the light of Quran and Sunnah, their rights
during the reign of KhilafiteRashida.
The second chapter about Islamic philosophy of rights, religious and political
rights of Minorities, meanings of right and different kinds of rights (haquq).
The third chapter gives the details of individual economic rights of minorities
in the light of Quran and Hadith, responsibilities of non-muslims in Islamic
state and their objections about Khiraaj and Jizya.
The fourth chapter is critical analysis of human rights in the Islamic
and western Law and comparative study of their charters has also been
conducted.
The fifth chapter is devoted for the existing position of the rights of Muslim
minority in west (France, Germany and UK).
The sixth chapter focuses on the universality of Islam and
Islamophobia, Western negative propaganda against Islam, limitations of
relationship with non-Muslims according Islam.
In the conclusion, benefits of this research, proposals and recommendations

This research deals with the question, is Islam is in favour of Pluralistic
society.It also explores the realistic analysis about the rights of Non-Muslims
in Islamic state and the miser situation of Muslims in western countries in
modern era. This Research enlighten the major problems of Muslims living
in western countries and recommenditions about the solution.
This study might helpful in legislation for the minorities in the wetern
countries and also in the Muslim countries.

Marriage holds its roots from the beginning of mankind. It is a relation (between man and a women) that is recognized by custom or law and which involves certain rights and duties of the couple and their children, marriage has thus two main functions to perform: it is the means adopted by human society for regulating relations between sexes; and it furnishes the mechanism by means of which the relations of a child to the community is determined. Islam recognized this institution and accepted it as the basis of a human society, after purging it of all the evils that had penetrated it.
First Chapter of this thesis covers the basic concept of marriage in the light of Islam. Marriage constitutes different purposes including; The Islamic purposes, social purposes, psychological purposes, training of the society including modesty and growth of the generations. Rules for Selection of one’s life partner and rights of husband and wife are also discussed in the light of Quran and Sunnah.
Second chapter discuss the matrimonial problems of and its causes. Problems are categorized in personal problems, family problems, children problems and financial problems. Survey and interview method has been used to find out problems of current era.
Third chapter is deep study of matrimonial problems impacts in all aspects. It discuss the impacts of problems on Personal life of couples, on their family, on children and society.
Fourth chapter provides the solution of problems discussed in the second chapter. Solutions of matrimonial and social problems are also discussed according to Quran and Sunnah and culture and society of this region.

The Qur'an al-Hakim has clarified the fact that there are two aspects to the iqamat
of religion, one is positive and the other is negative, commanding good and forbidding evil
is the main pillar of religion. Command to do good and forbid evil is another name of Hisba.
The real purpose of the Prophet Muhammad’s SAW revelation was to call to monotheism
and self-purification, as well as to reform one's morals. His Holiness was the authority on
all religious and administrative matters however, he had appointed officers and workers at
various places for the betterment of the situation, purification of morals and establishment
of justice.
After the Prophet's time, the short two-year caliphate of Hazrat Abu Bakr Siddiq (RA)
was full of emergencies. He did not spare a single minute in subduing them and at the same
time he did not feel the need to change the system from the time of the Prophet. When Hazrat
Omar Farooq (RA) flourished on the throne of the Khilafah, the system of government was
slightly different. In his time, Omar (RA) took a number of steps to promote public morality
and Islamic values, which were greatly expanded in this system. He also performed the duty
of ombudsman himself. There may not be a proper title for Hisba, but he did a good job of
all the things that can fall into the category of Hasba in any way. This article discusses
Hazrat Omar Farooq’s (RA) accounting system, describing the nature, methodology and
resources used in His time, here are some suggestions on how to look or get an appointment
for antique items.
The importance of research on this topic can be felt in view of the increasing (individual
and collective) corruption and disorder in the present,that the methods of Hazrat Omar
Farooq’s (RA) accounting system and their results and fruits should be collected in the
system of accounting in such a way that everyone can play his role in reforming the society

The Role of Auqaaf’s Masajid in Social Reforms :A study in the context of islamabad
Masjid has an important role in Muslim society. It had been a community
center in the reign of the Holy Prophet (saw), where He (saw) met with delegations, set
Muslim affairs and family matters, seeking and delivering knowledge, discussion about
Islamic laws and war plans were made in the mosque. The masjid had been basic role
in religious character building. The Prophet (saw) was glad to know children in the
masjid. Masjid has an active role in making a man punctual. The Muslim community is
ordered to be hurry when they hear the first Azaan For Jumatul Mubarak, and leave all
their works where those are. The masjid had been a center where all Sahaba E Kiraam
(the prophet (saw)’s companions) were made aware of their religious affairs and Islamic
laws, they were taught how to build their character. Women were allowed to go to the
mosques to pray five times a day. They asked a lot of questions about their affairs. War
plans were made in the mosque. The prophet (saw)’s companions were called to gather
in the mosque when a problem or an important task was needed. The prophet (saw)
asked his companions to give suggestions about the matter. When he (saw) went to a
war, after returning from it, he went to the masjid first. Later on He entered the home.
There are a lot of examples we can talk about.
Auqaaf masajid have not a specific syllabus but Khutbaa and Ulama (religious scholars)
of these masajid have started an active role in character building of the society, it has a
positive impact on the society. Auqaaf Aemma and religious personalities are working
for religious awareness of the society.

This thesis titled “An Analysis of contemporary education system in Pakistan with
respect to Molana Maududi and Mualana Munazir Ahsan Giyani’s thought”
This thesis presents overview of Seyed Maududi and Mualana Munazir Ahsan
Galan’s philosophical thoughts and its applications to education process. This research
encompassed a vast panorama of education system in Pakistan and its outcomes into
society. The purpose of this research is to analyze the education system and its
consequences on the society. The method of research is descriptive and qualitative.
The Muslims of the sub-continent wanted an independent Islamic state to live their
lives in accordance with the Islamic values where they could practice freely .Allah (S.W.T)
gifted the Pakistan a reward of their struggle .Before the independence, where other values
and traditions were framed by Europeans slave nation with fully covered their interest, their
education system was also framed to back up their goals. This system lasted so many
impacts in the Muslim society of Sub Continent the impacts of their targeted educational
system still exist clearly in after world education system.
After the 1857 war of independence, Sir Syed Ahmad Khan introduced an
educational system for Muslims of India in the form of Ali Garh movement witch aimed at
getting the favor of the ruling class.
Conversely, the Scholars of India focused on the educational system which
consisted of pure Islamic, religious and human values having deep effects later on. Among
them was Seyed Maududi and Mualana Munazir Ahsan Giyani’s who deeply studied the
former Muslim educational system, the British educational system and after world system.
These two educational system created such gap and differentiation between religious and
world that was undoubtedly, un.Islamic and this concept was harshly criticized by the
educational experts.
Seyed Muadoodi and Mualana Munazir Ahsan Giyani’s who after contemplating
the current issues of the situation not only rejected the concept of rejection of religion and
world but also introduced a complete educational system based on Islamic values.
After the independence, the same system got established in the country witch once
resulted in our demise both religiously and as nation even though the objective of
independence was the establishment of Islamic values. The study also found that education
we gave is entirely purposeless not fulfilling our national cultural and religious needs.
Above all is that the generation we educated is highly corrupt immoral and materialistic
due to meaningless education system.
As research aimed to provide some glimpse of Seyed Maududi and Mualna Munazir
Ahsan Giyani’s education thought in an outline form it warrants a comprehensive and
obtained study on the reconstruction of education thought in context of Seyed Maududi and
Mualana Munazir Ahsan Giyani’s philosophy.

Allah (SWT) created man in his perfect form and declares him in Islamic Sharia
as the superior creation. Each human being is blessed by Allah with specific qualities and
attributes, some of them receive physical blessings while others are endowed with
wisdom. If someone is subject to a deformity, he is compensated with an additional
attribute by God. These defective people are classified as special people. Islamic
teachings place great emphasis on the polite and helpful attitude towards special people
and make them a successful member of society. The Holy Prophet (PBUH) himself
assigned the specified responsibilities to these people in almost all areas of life. These
people have remained active through all eras of the past and have also played their vital
role in modern times. The subject of current research is "The Role of Special Persons in
the Development and Progress of The Muslim Society: A Critical and Analytical Study".
The contribution of special people in society has been an integral part of social and
academic development since the time of the Holy Prophet (PBUH).The history of Islam is
replete with examples of so many special people who have contributed in all areas of life
i.e. socio-political, economic, educational, religious and administrative. In modern times,
these peoples are treated as inferior in society due to their physical challenges. The
ignorant attitude of the society may lead them to promote criminal and negative activities.
The objective of this research is to clarify the role of a special person in a society, to
identify problems of special persons and provide possible solutions to their challenges
and to build role models for the current special persons. First, to highlight the role of a
special person from the teachings of Islamic Sharia and early Islamic ages in the
propagation of Islamic values, second, to encourage them to be a valued member in all
areas of life. The descriptive research approach is applied to clarify data from early
Islamic history. The survey technique has been adopted for collecting data from
contemporary special people. The study attempts to highlight aspects of Muslim history
regarding the contribution of special people to the progress of The Muslim society,
realizing their ability to transform it by actively participating in all areas of life, including
religion, society, politics, administration and economics. The study summarizes the role
of special people in development and progress at their respective ages, including present
times. Research will be significant in clarifying the role of the special or disabled person,
highlight their hidden abilities and make them a helping entity in the progress and
development of society rather than as a burden. Their involvement in the socio-political,
economic, academic and religious affairs of society like normal people will also help to
minimize the negative elements of society i.e. begging, theft, alcohol consumption , etc.
on the one hand. On the other side, these special people will also be empowered and
respected in society by saving their self-respect.
Allah has bestowed upon us a great blessing that he has blessed us with
a great blessing like Islam, and then Allah has sent his Prophets from
time to time for the Guidance of Mankind. From Hazrat Adam (A.S) to
Hazrat Muhammad (S.A.W), all the prophets have presented a
straightforward religion to the world.
All these prophets have presented the original shape of Islam to the
people, but unfortunately, after centuries, the dust fell on the original
shape of Islam, some people tried to change the original form of
religion, and the condition of Islam today is that in Islamic beliefs, in
worship, in matters and in civilizations many new things have been
added which have no concern with Islam.
This Thesis not only identifies new things in beliefs, worship matters
and civilizations, but also what strategies can be adopted to prevent such
new things in religion in the future.
Islam is a universal religion ordained by Allah, the lord of glory, in
which Allah has embraced the virtues of all the previous religions but
laws have been formulated in Islam through which the society can be
taken in the right direction.
The thesis also deals with such laws, in light of which make sure to
bring reforms in all fields including media in the light of divine
teachings and teachings of the Prophet (PBUH).

The country of Pakistan is a gift from Allah almighty which came to being in the name of
Islam. With the establishment of Pakistan, some external powers started using their tactics
to create hurdles for Islamic republic of Pakistan to not become an Islamic state and make it
a secular country. One of these nefarious elements is the establishment of non-Muslim and
liberal NGOs. These NGOs introduced many high causes to make their existence stronger,
but behind the scenes, they left many negative marks on every sector of Pakistan.
The thesis not only highlights the issues under which these organizations have shown their
influence over other Islamic countries, but also the threats to Pakistan, especially in the field
of education. The growing trends of these organizations have been highlighted to make it
easier سto protect Pakistan’s Islamic identity from all such threats.

method of research is concerned, this article is historical, critical and analytical.
The first chapter is consisted of introduction, definition and effects of liberalism on Islamic
countries.
The second chapter is about the causes of liberalism, lack of education and awareness, lack
of attention towards the cause of media from media and emerges of non-Muslim NGOs in
the Muslim countries. The third and last chapter deals about the way out and solutions of the

If we want to understand or summarize the whole article in two sentences, then ancient
liberalism has its own place with many features, while our point of criticism is only modern
and contemporary liberalism which with bad attributes has become a challenge for real faces
(ancient liberalism).
That is why we politely suggest that the writers and true liberals should make the difference
between these two types of liberalism in front of the common man so that the opponents of
liberalism (from whatever sect they belong to) do not get a chance to have a negative
impression of true liberalism.
