Abstract
My topic is as under: “An analysis of the presence of Afghan refugees in Pakistan, and their return, in the light of Shariah and law”. In the first chapter of this thesis I have highlighted the virtue and importance of migration, contract between Muhajareen and Ansaar, virtue of Muhajareen and Ansaar, and the rights of Muhajareen. In the second chapter I have introduced Afghan refugees, causes of their migration and the services provided to them by various departments in Pakistan. Since this thesis is about Afghan refugees, their introduction was necessary. The time after the migration is the most important and difficult one for Ansaars, because they have to arrange for the sustenance and lodgings for the coming guests. For this purpose, in the third chapter, the services done and steps taken for the Afghan refugees by the Pakistan government are mentioned. Besides, the sense of sacrifice and brotherhood in Pakistani people is elaborated, because they have welcomed the Afghan refugees with such great sacrifices and brotherly affection that after Ansaar of Madina, it, s like is difficult to find in history. In the fourth and last chapter and an endeavor is made to explain their exile from Pakistan, when they have been living here for forty years, and their two generations, after getting educated here, are acting as ambassadors between the two countries. At the end of this chapter, the difficulties and dangers waiting for the refugees, in case they return to Afghanistan, are presented. In this situation, it is not without risk to send them there by force, as the situation in Afghanistan is getting worse by the day. They had run for their life from an infidel Russia, and now, in the form of NATO, a force of forty non-Muslim countries do not hesitate in committing any oppression. Therefore, it is not right to send them there.
