Abstract
The rights and obligations of non-Muslim minorities in Muslim-majority societies have long been a subject of academic and legal discourse. In recent years, concerns about the treatment of non-Muslims in Islamic societies have gained international attention, particularly regarding issues of legal protection, religious freedom, and social inclusion. This study examines the legal, historical, and theological foundations of non-Muslim rights within Islamic jurisprudence, with a special focus on the Constitution of Medina and its implications for contemporary Muslim societies. Using Pakistan as a case study, the research explores how the country's constitutional framework addresses the rights of non-Muslims, analyzing its alignment with Islamic principles and international human rights standards. The study employs a comparative legal analysis, evaluating the provisions of the Constitution of Medina and Pakistan's legal structure to identify similarities, differences, and areas for reform. It investigates key challenges faced by non-Muslim minorities in Pakistan, including legal protections, socio-political representation, and instances of discrimination or marginalization. By conducting a thorough examination of historical Islamic governance models and their application in modern nation-states, this research seeks to contribute to a more nuanced understanding of religious coexistence in contemporary Muslim societies. The findings highlight the need for stronger legal mechanisms to ensure the full implementation of constitutional protections for non-Muslims, addressing both theoretical and practical gaps. The study concludes with recommendations for legal and policy reforms aimed at fostering interfaith harmony, social justice, and equitable rights for all citizens, regardless of religious affiliation. By bridging historical Islamic frameworks with modern legal systems, this research aspires to provide meaningful insights into the evolving discourse on minority rights in Muslim-majority states.
