Abstract
Medical science is progressing with time. Diseases that were once fatal and dangerous can now be treated, and steps are being taken to get rid of them at their source. We can see how those modern treatment methods differ from those of the past. Among them are medical banks, namely blood banks, sperm banks, eye banks, human skin banks, and bone banks. In these banks, organs and other human body features are stored for use. This research is related to modern medical problems, which is the most important need of the time to review in the light of Islamic jurisprudence. This research attempted to fill a gap in the Islamic literature. This is why protecting human life is at the top of the list of objectives in Sharia, and the same goal is discussed in medical science. Modern medical banks are among the most important. The main goals of this research are to determine what led to the creation of medical banks and what they are used for. This is mandatory to find a solution in the light of Islamic jurisprudence by examining the treatment methods in the banks and preparing Sharia guidance in the field of medicine for medical experts. This study attempted to determine the importance of establishing medical banks and their treatment procedures. This study highlights the legal status of medical banks in light of Islamic jurisprudence. Also, the study shows medical experts how Islamic law can be used to solve modern medical problems related to Shariah. The study has an introduction that talks about the topic, its importance, some basic questions, the goals and objectives of the research, a review of the literature, the limits of the research, and how the research will be done. In this thesis, analytic research methodology was used. The qualitative research method has been adopted to conclude. In detail, the opinions of relevant medical bank experts are looked at in the introduction, history, and method of each medical bank. To evaluate each bank, primary and secondary data from basic books, research articles, and critical, logical, and scientific arguments were used. In this research, seven medical banks (Blood Bank, Sperm Bank, Skin Bank, Bone Bank, Eye Bank, Hair Bank, and Human fat Bank) have been analyzed in light of Islamic jurisprudence. The research is split into four chapters, and some of the smaller chapters talk about and analyze seven banks. Also, the method of treatment in each bank, the history, reasons, and motivations, organ preservation resources, expected concerns, blood transfusion methods, artificial insemination options, different cases, details of human organ transplantation, skin transplantation, and usable eye organs. Then, the Shariah position on each bank was explained in light of the Quran, Hadith, & Islamic jurisprudence, the writings of Muslim scholars, books of objectives, books of jurisprudence, modern fatwas, encyclopedias, and jurisprudential academies. After all discussion and analysis, the summary of the study conclusions, recommendations, indexes, and list of sources and references are also mentioned. Hopefully, this research will prove to be a good effort for medical experts and those looking for the Shariah point of view regarding medical problems.
