Abstract
In Islamic family system, institution of marriage (Nikah) is managed in handful way to achieve the happiness of this life and hereafter. A marriage contract is organized through provisions of mutual rights and duties of spouses in refined legal matrix of Islamic jurisprudence. A failure to meet the fundamentals of society at any level leads to court marriage, divorce (Talaq), separation (Khulah), and other social disorders. This deviation may lead a prospering society to tension, frustration, wrestling, jealousy, and enmity which must ruined human ties among different segments of society. This study is an analytical study on “increasing trend of divorce in case of court marriages and its impact”. In 1st chapter, there is defined court marriage and concept of divorce in light of Shariah. The second chapter discusses analytically the causes, losses, remedies to increasing trend of divorce generally and in cases of court marriages especially. The prevailing laws and regulation to file a court marriage is documented in context of federal capital and the survey in conducted for the cases appeared in federal capital through floating different questionnaires on above mentioned topic. The fourth chapter evaluates the impact of court marriage on behaviors of people in context of the existing norms of society. Last, but not least the fifth chapter concludes the subject matter with limitations of study and recommends some of accurate policy stances to stop the trend of court marriages and the increasing trend of divorce through legislation and other social solutions to the problems. This study is equally important for general public for awareness, for academicians to extend it further, and for policymakers to control these alarming trends which may vanish the existing social ties among society.
